Si Chan Wooh, a former senior officer of SSI International who was responsible for Schnitzer Steel's Asian scrap metal sales pled guilty in June 2007 to one count of conspiracy to violate the FCPA. Mr. Wooh admitted having authorized and made bribe payments, disguised as commission payments, to managers of Chinese state-owned steel production companies between 1995 and 2004, in exchange for their purchasing scrap metal from Schnitzer. Sentencing was delayed several times, and on October 14, 2011, the DOJ moved to dismiss the criminal information against Wooh, citing "prosecutorial discretion in the interests of justice and the efficient use of government resources." That motion was granted on October 17, 2011.

The plea agreement provides for a base offense level of 12, a 2 level increase for multiple bribes, a 12 level increase for corrupt payments to government-owned customers of more than $200,000 but less than $400,000, a 2 level increase for his role, and a 3 level reduction for acceptance of responsibility, for a proposed final offense level of 25. Subject to continued cooperation, the government intends to request a 15 level reduction for substantial assistance, which would yield a final offense level of 10 and a sentence range of 6 to 12 months.
