Despite discovery through an internal investigation of certain aspects of the improper activities, Brown and others thereafter devised new schemes to raise cash in Nigeria in order to honor preexisting improper "commitments" and entered into a new "consultancy" agreement for the purpose of continuing to make illegal payments to Nigerian officials.

As part of Brown's settlement with the SEC, in addition to the interlocutory judgment enjoining him from violating or assisting another in violating the FCPA in the future, the court will "determine whether a civil penalty ... is appropriate and, if so, the amount of the penalty" upon the Commission's future motion. The SEC action against Brown is stayed pending resolution of the criminal matter. Brown has pled guilty to criminal violation of the FCPA and is cooperating with DOJ's continuing investigation into the Willbros matters. He will be criminally sentenced when his assistance is no longer needed by the DOJ.
