In approximately October of 2000 and June of 2002, Thermo King Ireland was awarded a contract valued at approximately 706,148.49 euros with the Government of Iraq for the sale of spare parts for refrigerated trucks under the United Nations Oil for Food Program. Thermo-King Ireland secured this contract through an offer to pay a kickback in the amount of 64,197.46 euros to the Iraqi government. The kickback was authorized by an Irish employee of the company who acted as the Regional Sales Manager for the Middle East and Africa, based out of Dubai. The kickback was approximately 10% of the value of the contract to be awarded. The kickback was to be paid to the government through an Iraqi sales agent. The contract, with the 10% payment included in the price, was submitted for approval to the United Nations. Thermo-King struggled to get approval and as of June 17, 2002, approval had not been granted for the shipment of the parts to Iraq.
