Following the indictment and after reviewing the available evidence against Pinkerton, the government found further prosecution of Pinkerton was not in the interests of justice and dropped the charges against him.

A federal grand jury indicted Pinkerton along with Viktor Kozeny, the alleged mastermind in a bribery scheme connected to investments in the privatization of SOCAR in Azerbaijan.

In 1998, Pinkerton was the managing director of the American International Group, Inc. (AIG) Global Investment Corporation, a unit that managed billions of dollars in AIG's private equity funds. The indictment alleged that Pinkerton caused AIG to make substantial investments in Kozeny's companies, Oily Rock and Minaret, based in part on his understanding that Kozeny had offered, paid, authorized, or would pay bribes to Azeri officials to ensure the investment consortium's participation in SOCAR's privatization.

In June 2008, the government requested an order of nolle prosequi disposing of all counts in the indictment against Pinkerton. Based on the evidence acquired since the filing of the indictment, the government concluded that further prosecution of Pinkerton in this case would not be in the interest of justice.

Before dismissal of the case against him, Pinkerton and another codefendant, Frederic Bourke, had successfully won dismissal of numerous counts against them in the original indictment as time-barred by the relevant statute of limitations. Bourke, however, was tried and convicted in 2009. Kozeny remains a fugitive.
